An Austin certified nursing assistant (CNA) was recently arrested and charged with misdemeanor injury to the elderly by contact.
The CNA worked at a nursing and rehabilitation facility and has been accused on posting inappropriate photos of a patient on Snapchat. One photo showed the elderly patient’s hand covered in feces. Another photo someone touching the patient’s nose with a tissue, in an apparent effort to get her to touch her nose with her soiled hand.
The crime of injury to an elderly person
Texas Penal Code Section 22.04 states that a person commits the criminal offense of injury to an elderly or disabled individual if they intentionally, knowingly, recklessly, or with criminal negligence, by act or intentionally, knowingly, or recklessly by omission, causes to a child, elderly individual, or disabled individual: serious bodily injury; serious mental deficiency, impairment, or injury; or bodily injury.
This criminal can be applied to the owner, operator, or employee of a group home, nursing facility, intermediate care facility for persons with mental retardation, or other institutional care facility under certain circumstances.
Nursing home and rehabilitation facility negligence
Separate and apart from the criminal side of how facilities treat the elderly, patients and their families can sue in civil court to seek compensation for mistreatment.

Currently, the Texas Department of Aging and Disability Services (DADS) is the state agency that deals with licensing, inspection, and regulatory issues concerning facilities that provide aging and disability services. DADS is in the middle of a two-year transition where its mission will be taken over by Texas Health and Human Services (HHS). As a result, DADS will cease to exist by September 1, 2017.
